Privacy Policy

For the purposes of this Privacy Policy, "us", "we" or "our" means Professional Publishers Pty Ltd ABN 87 094 164 271 t/as Australian Business For Sale® ("AB4S"). The word "you" includes website visitors, AB4S registered members and users of AB4S products and services.

The purpose of this Privacy Policy is to inform you about:

  • The kind of information collected by AB4S
  • How AB4S uses the information collected
  • With whom the information may be shared
  • How to opt in or out
  • What security procedures are in place to protect the loss, misuse or alteration of your personal information

We are bound by the National Privacy Principles contained in the Privacy Act 1988 (Cwth) (subject to exemptions that apply to us under that Act).

We may, from time to time, review and update this policy, including to take into account new or amended laws, new technology and/or changes to our operations. All personal information held by us will be governed by the most recently updated policy.

What kind of information is collected by AB4S?

The type of information that AB4S collects about you is dependent on how you use the services offered on our website and the products you are interested in purchasing. In general, AB4S gathers two types of information about you, namely:

1) Aggregated information generated by our systems (or third party systems) to track our website traffic but that which does not identify you personally. We generally use this information to report statistics, analyse trends, administer our services, diagnose problems and target and improve the quality of our products and services. To the extent this information does not constitute personal information, the National Privacy Principles do not apply and we may use this information for any purpose and by any means whatsoever.
2) Personal information about you such as your name, address, telephone and facsimile number, email address and in some cases, your billing details and general financial and credit information. Generally, AB4S does not collect 'sensitive information' about you. AB4S will only collect sensitive information about you in the event that it is necessary for the purpose of providing you with a product or service. In such circumstances, AB4S will only collect sensitive information with your consent unless we are required by law to collect such information from you.

How does AB4S use the information collected?

AB4S may collect personal information about you when you visit our website and you elect to use our on-line services, when you register as an AB4S registered member, when you enter into a contract with AB4S and, when you deal with AB4S over the telephone or correspond with AB4S via facsimile, letter or email or any other mode of communication.

“Cookies” are data that a website transfers to an individual's hard drive for record-keeping purposes. Cookies, which are industry standard and are used by most websites, including those operated by us, can facilitate a user's ongoing access to and use of a site. They allow us to customise the website to your needs.   • to conduct AB4S marketing activities

  • to investigate any complaints about or made by you, or if we have reason to suspect that you are in breach of any of our terms and conditions or that you are or have been otherwise engaged in any unlawful activity; and/or
  • as required or permitted by any law (including the Privacy Act).

Copies of correspondence sent from the web site, that may contain personal information, are stored as archives for record-keeping and back-up purposes only

Disclosure of personal information to third parties

AB4S may disclose your personal information to our advertisers in order to facilitate your expression of interest in a business opportunity.

AB4S may also disclose your personal information to third party contractors who perform services for us including the management and maintenance of our information systems. Where your personal information is passed on to third party contractors, AB4S takes reasonable steps to ensure that these individuals and/or organisations are bound by confidentiality and privacy obligations in relation to the protection of your personal information.

Other than as outlined above, AB4S will not disclose your personal information without your consent unless disclosure is necessary to prevent a threat to life or health, authorised or required by law, reasonably necessary to enforce the law or necessary to investigate a suspected unlawful activity.

Opting in or out

At the point we collect information from you, you may be asked to “opt in” to consent to us using or disclosing your personal information other than in accordance with this policy or any applicable law. For example, you may be asked to opt-in to receive further information or communications from our advertisers and members.

You will generally be given the opportunity to “opt out” from receiving communications from us or from third parties that send communications to you in accordance with this policy. For example, you will be given the option to unsubscribe to reports & e-newsletters sent by us.

If you receive communications purporting to be connected with us or our services that you believe have been sent to you other than in accordance with this policy, or in breach of any law, please write to us at the address set out below.

What security procedures are in place to protect the loss, misuse or alteration of your personal information?

We strive to ensure the security, integrity and privacy of personal information submitted to our site, and we review and update our security measures in light of current technologies. AB4S takes reasonable steps to protect the security of your personal information that we hold from misuse, loss, or unauthorised access, including by means of firewalls, password access, secure servers and encryption of credit card transactions.

However, you acknowledge that the security of online transactions and the security of communications sent by electronic means or by post cannot be guaranteed. You provide information to us via the internet or by post at your own risk. We cannot accept responsibility for misuse or loss of, or unauthorised access to, your personal information where the security of information is not within our control.

You acknowledge that we are not responsible for the privacy or security practices of any third party (including third parties that we are permitted to disclose your personal information to in accordance with this policy or any applicable laws). The collection and use of your information by such third party/ies may be subject to separate privacy and security policies.

If you suspect any misuse or loss of, or unauthorised access to, your personal information, please let us know immediately.

How you can access and change any personal information or contact AB4S

Subject to some exceptions in the Privacy Act, you have the right to seek access to and update the personal information we hold about you. If you make an access request, we will ask you to verify your identity. AB4S may recover any reasonable costs incurred in providing you access to the requested information.

AB4S registered members will generally be able to access and update their membership details online.

We request that you keep your information as current as possible so that we may continue to improve our service to you.
